| Alright guys I got caught drink driving on friday night, I took my car round the street and crashed it it was unmovable so i left it there and came back in the house. The police came about half an hour later and I was arested blowing 86 in the breath test. It's my first ever offence etc I'm just wondering if any of you know what kind of punishment I would be looking at and if I should try and say I wasnt drunk at the time etc.. Thing is I'm applying for the army and they won't take me on as long as I'm banned and I'm not sure if the conviction even after that will still have effect. I have court the 24th of may and please no sarcastic comments I'm really worried here tbh and just seeking any advice or help, thanks. | |

| thats very sad.
One of my firend made prison for drive while drunk (cause he was on probation)
Sadly i dont have any advice .. i really dont have any experience over the law etc ...
Maybe taking advice from a layer ?
Since it look pretty much huge for you and your army stuff ...
Sorry am such a poor help, hope yull find a way. keep me inform.
(PS: alot of my firends went to course for minor dely and pledy innocent and that actually work. But it was for minor thing such as making your stop good etc.)
Also if your planning on lying to the course, be warn that this is alot of pressure.. like i know that i just cant do it, i would became all red and the judge would be ''your such a bad lyer jedi'' and i would get cut.

| Basically your punishment really depends on exactly where you live (different cities/cops etc have different policies). First thing for any charges like that is, never admit you are guilty. Don't necessarily deny it, but leave it to them to prove you are. You kinda already screwed yourself by taking the breath test when the police came... There's no real denying against that evidence (I'm good friends with a criminal defense lawyer, and his advice is to never blow.)
If they have enough evidence to convict you, you are basically at their mercy at that point, I'd just do research on local laws to know what to expect. If it's a first offense and you didn't injure somebody, you're probably getting put on probation and getting a criminal record and possibly a fine.

| I never knew about the breath test, I didn't know you could refuse and I would of thought it would be worse if I did refuse. It is a first offence and I'm pretty sure I will get a ban minimum one year but I really hope it isn't more than that. I think it could be worse because I crashed and the breath test was pretty high from what I have read so far. Just feel terrible man and don't know what I'm going to do if I get a longer ban, I have done alot of work with kids as well and it's looking like that will be done with a drink driving conviction. Nothing I can really do now but hope for the best, I'm going into make an appointment with a lawyer etc tommorrow and I'll just have to take it from there I suppose.. | |

| Imo..Don't lie. Wouldn't be smart to add perjury to the problem. As for punishment...prolly 1 year ban and i wouldn't think any jail time since it's first offense. Max Jail Time for first offense without killing anyone or damaging anything too serious I think is 6 months, I'm sure it depends on the judge, country, and situation. DUI is a bad one..Sorry it happened. | |

| I would be happy with a one year ban tbh I'm dreading any longer than that though, as it will hold off being able to join the army. Anyway I made an appointment with a lawyer today and the car is getting taken to my local garage later on, I'll keep you guys posted on how things go, thanks for the advice etc! Except Kapkin you suck. | |
